Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Moonbrush Inc. (“Moonbrush,” “we,” “us” or “our”), a Wyoming corporation. They govern your use of moonbrush.com and its pages, content and forms (the “Site”).
By using the Site, you agree to these Terms and to our Privacy Notice and Cookie Policy. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you confirm that you have authority to accept these Terms for it.
What these terms cover
These Terms cover the public website only. Our products and services, including atlas, stage and Gravity, client platforms, data and deliverables, are provided only under signed agreements with our clients. If a signed agreement between you or your organization and Moonbrush conflicts with these Terms, the signed agreement controls. Nothing in these Terms changes the terms of any signed client agreement.
Eligibility
You must be at least 18 years old to use the Site.
Permitted use
You may view, download and print pages from the Site for your own information or your organization’s internal evaluation of Moonbrush. You may share links to the Site. Any other use requires our prior written permission.
Prohibited uses
You agree not to:
- scrape, crawl, harvest or copy content or data from the Site by automated means, except for standard search engine indexing that follows our robots.txt file;
- reverse engineer, decompile or attempt to extract the source code of the Site, or attempt to infer the design of our models or data from it;
- probe, scan or test the security of the Site or our systems without our prior written permission, or attempt to gain access to any system or data you are not authorized to access;
- interfere with or disrupt the Site, including by introducing malicious code or placing an unreasonable load on our infrastructure;
- misuse our forms, including by submitting false or misleading information, submitting information about another person without their authority, impersonating anyone, sending spam, or using forms to deliver malicious code;
- use the Site in violation of any law, or to infringe anyone’s rights; or
- frame or mirror the Site, or present its content as your own.

Intellectual property
The Site and its content, including text, graphics, illustrations, logos, software and the selection and arrangement of content, are owned by Moonbrush or its licensors and are protected by copyright, trademark and other laws. Except for the limited permission above, no license or other right is granted to you.
Moonbrush, atlas, stage and Gravity are trademarks of Moonbrush Inc.; applications to register them are pending. You may not use them without our prior written permission, except to refer to Moonbrush and its products accurately.
Other names, logos and trademarks on the Site, including those of clients, partners, integrations and standards bodies, belong to their owners. Their display does not imply endorsement of Moonbrush by their owners, or any affiliation beyond what the Site describes.
Accuracy of content and forward-looking statements
We work to keep the Site accurate and current, but its content is provided for general information only. Content may be incomplete, may become out of date, and may change without notice. Nothing on the Site is legal, financial, regulatory or other professional advice, or an offer that can be accepted to form a contract.
Some content describes our plans, expected capabilities, product direction or other future events. These forward-looking statements reflect our current expectations and are subject to risks and uncertainties. Actual results may differ materially. We have no obligation to update them.
Case studies and results
Case studies, results, metrics and descriptions of client work on the Site describe specific engagements. Results described reflect specific engagements and are not a guarantee of results. Outcomes depend on many factors, including each client’s data, goals, channels, creative and market. Any commitment Moonbrush makes about performance appears only in a signed agreement.
Links to third-party sites
The Site may link to websites and services we do not control, such as a third-party billing portal, publications and social media. We are not responsible for their content, terms or privacy practices. A link does not mean we endorse the linked site. Your use of a third-party site is governed by its own terms.
Feedback
If you send us ideas, suggestions or other feedback about the Site or Moonbrush, we may use it for any purpose without obligation or compensation to you. Please do not send us confidential information through the Site’s forms. If you want to share confidential information with us, ask us about a non-disclosure agreement first.
Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, MOONBRUSH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOONBRUSH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING IT.
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent the law allows.
Indemnity
You agree to defend, indemnify and hold harmless Moonbrush and its officers, directors, employees and agents from any claims, losses, liabilities, damages and expenses, including reasonable attorneys’ fees, arising out of your breach of these Terms or your misuse of the Site.
Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state and federal courts located in New York County, New York, and you and Moonbrush consent to their personal jurisdiction. This section does not change the terms of any signed client agreement, including its governing law and dispute resolution provisions.
Changes to these terms
We may update these Terms from time to time. When we do, we change the date at the top. Changes apply from the date they are posted. If you keep using the Site after that date, you accept the updated Terms.
General
If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the policies they reference, are the entire agreement between you and Moonbrush about the Site.
